Good Faith and Renegotiation
A Multidisciplinary Approach

This study analyzes the role of good faith in negotiation as a structuring mechanism for cooperation in conflict contexts. Based on an interdisciplinary approach that integrates game theory, rational choice theory, and human motivation theory, it examines how good faith operates throughout the negotiation process (iter negotiationis). In the preliminary phase, it manifests as trust (subjective good faith), enabling the transition to negotiative interaction. During the negotiation, it acquires an objective dimension, expressed through duties of loyalty, transparency, and communication oriented toward mutual understanding. In the implementation stage, good faith fulfills a dual function: it ensures consistency with the commitments undertaken and, at the same time, provides the basis for adapting the agreement to unforeseen changes through renegotiation. It is concluded that good faith acts as a homeostatic mechanism that transforms the uncertainty of conflict into cooperative dynamics, fostering sustainable, equitable, and legally stable agreements.
